Agricultural and horticultural products of Kashmir: a case for legal protection as geographical indications in India

نشانه جغرافیایی، یک حق انحصاری جامعه، نقش‌های حیاتی مکان، اقلیم و دانش انسانی را در تمایز محصولات بر اساس ویژگی‌های ذاتی منحصر به فرد آن‌ها به رسمیت می‌شناسد. این ابزار قدرتمندی برای حفاظت و پاداش دادن نه تنها به پتانسیل بازار محصولات ممتاز، بلکه به دانش سنتی مرتبط با آن‌ها نیز است. از زمان تصویب قانون نشانه‌های جغرافیایی کالاها (ثبت و حفاظت) در سال ۱۹۹۹، تاکنون ۱۱۲ مورد محصول کشاورزی موفق به دریافت برچسب GI شده‌اند که محصولات باغبانی بیش از ۷۵٪ از کل را تشکیل می‌دهند. مالکیت نشانه‌های جغرافیایی در محصولات کشاورزی و باغبانی توسط ایالت‌ها، فعالیت ایالت‌های مهاراشترا و کارناتاکا را نشان می‌دهد. از نظر صنایع دستی، جامو و کشمیر دارای هفت نشانه جغرافیایی است که قبلاً شهرت و اعتبار زیادی در سطح جهانی کسب کرده‌اند، مانند پشمینه کشمیر، شال کانی و غیره.با این حال، در حالی که سایر ایالت‌ها محصولات کشاورزی و باغبانی خود را به‌طور جغرافیایی معرفی می‌کنند، جامو و کشمیر تنها برای یک محصول کشاورزی، یعنی زعفران (Crocus Sativus)، موفق به کسب وضعیت نشان جغرافیایی (GI) شده است. از نظر سایر محصولات مشابه مانند سیب، گردو، بادام، زیره سیاه، برنج و غیره، جامو و کشمیر هنوز هیچ اقدامی برای ثبت آن‌ها به‌عنوان نشان جغرافیایی انجام نداده است. این مقاله به بررسی نشانه‌های جغرافیایی مختلفی می‌پردازد که می‌توانند با توجه به آمار درآمد حاصل از چنین محصولاتی برای ثبت مدنظر قرار گیرند. همچنین چالش‌ها و تهدیدهای مختلفی که بخش‌های کشاورزی و باغبانی در جامو و کشمیر با آن مواجه هستند را بررسی می‌کند.

Geographical Indication, an exclusive community right, recognizes the critical roles played by location, climate, and human know-how in distinguishing products based on their unique intrinsic characteristics. It is a powerful tool for safeguarding and rewarding not only the market potential of elite items, but also the traditional knowledge associated with them. Since the passing of the Geographical Indications of Goods (Registration and Protection) Act in 1999, 112 agricultural items have received GI tags till now with horticultural items accounting for more than 75% of the total. The ownership of GIs in agricultural and horticultural crops by state indicates Maharashtra and Karnataka activism. In terms of handicrafts, Jammu and Kashmir has seven GIs that have already established enormous goodwill and reputation on a global scale, such as Kashmir Pashmina, Kani Shawl etc. However, while other states are geographically indicating their agricultural and horticultural products, Jammu and Kashmir has only earned GI status for only one agricultural product, namely Saffron (Crocus Sativus). In terms of other similar products such as Apple, Walnut, Almond, Black Zeera, Rice, and so on, Jammu and Kashmir has yet to take any initiative to register them as GIs. This paper discusses different geographical indications which could be considered for registration in the light of statistical figures of revenue generated bysuch products. It also discusses various challenges and threats which the agricultural and horticultural sectors in Jammu and Kashmir are facing.
